Evidence Collector - Privacy Policy

This Privacy Policy (this "Privacy Policy") explains how Voice Products, Inc., a Kansas corporation (referred to as "Voice Products," "we," "our," "us," and similar terms) collects information from users (each referred to as "you," and similar terms), and how we use and share that information.  We provide a variety of services through our mobile app (the "App") and any other software that we make available to you (collectively, the "Evidence Collector Platform").  Our services include providing a means for collecting and storing evidence in connection with the adjustment and processing of insurance claims, and all other services that we provide through the Evidence Collector Platform now or in the future.   By using the Evidence Collector Platform, you agree to the terms of this Privacy Policy. 

  1. Where this Privacy Policy Applies. This Privacy Policy applies to all use of the Evidence Collector Platform.
  1. Changes to this Privacy Policy. We may make changes to this Privacy Policy from time-to-time. All changes will be effective when posted on the Evidence Collector Platform, unless we specify a later date. If we make any material changes to this Privacy Policy, we will notify you through the Evidence Collector Platform, by email, or other communication. We encourage you to read this Privacy Policy periodically to stay up-to-date about our privacy practices. As long as you use the Evidence Collector Platform, you are agreeing to this Privacy Policy and any updates we make to it. If you do not agree to the updated Privacy Policy, you may not continue to use the Evidence Collector Platform, and your only option will be to terminate your account.
  1. Information We Collect.
  • Account Information. When you register an account, you may give us your name, company, email address, and any other information that we request or require. If you do not wish to provide any information that we require you to provide in order to create an account, then your only option will be to not create an account and not use the Evidence Collector Platform.
  • Communications. If you contact us directly, we may receive additional information about you that you provide to us.
  • Usage Data. To provide the Evidence Collector Platform to you, and to help us understand how you use the Evidence Collector Platform and to help us improve the Evidence Collector Platform, we automatically receive information about your use of the Evidence Collector Platform and other Usage Data.  "Usage Data" does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our App, device event information, hardware settings, and other technical information.
  • Location Data. We collect location data such as information about your device's location, which can be either precise or imprecise. How much information we collect depends on the type and settings of the device you use to access the App. For example, we may use GPS and other technologies to collect geolocation data that tells us your current location (based on your IP address). You can opt out of allowing us to collect this information either by refusing access to the information or by disabling your Location setting on your device. Note however, if you choose to opt out, you may not be able to use certain aspects of the Evidence Collector Platform.
  1. How We Collect Information. We collect information through the use of "cookies," tracking pixels, beacons and similar technologies to understand how you use the Evidence Collector Platform and interact with advertisements, to learn what content is popular, and to save your preferences. Cookies are small text files that web servers place on your device; they are designed to store basic information and to help websites and apps recognize your browser. You should consult your web browser(s) to modify your cookie settings to meet your priorities. Please note that if you delete or choose not to accept cookies from us, you may be missing out on certain features of the Evidence Collector Platform and your use of the Evidence Collector Platform may be negatively affected.
  1. How We Use Information We Collect. We use the information we collect from all users to:
  • Facilitate account creation and management.
  • Communicate with you, including for administrative, marketing and promotional purposes;
  • Manage user accounts;
  • Personalize the Evidence Collector Platform;
  • Provide you with customer support;
  • Provide you with Personal Data;
  • Operate our business and provide, improve, expand, and promote the Evidence Collector Platform;
  • Provide you with access to third-party products and services;
  • Protect our users and the Evidence Collector Platform, by, for example, fraud monitoring and prevention;
  • Enforce our terms, conditions and policies for business purposes, to comply with legal and regulatory requirements or in connection with our contract;
  • Obtain feedback; and
  • Analyze how users use the Evidence Collector Platform.
  1. How We Share Your Information.
  • As Agreed. We will use your data if you have given us specific consent to use your data for a specific purpose.
  • Legitimate Interests. We may process your data when it is reasonably necessary to achieve our legitimate business interests.
  • Legal Obligations. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal process, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
  • Vital Interests. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.
  • Usage Data and Personal Data Shared with Third Parties. We provide Usage Data and Personal Data to third parties to help us improve our services and to inform our advertisers, parties that sell products through the Evidence Collector Platform, and other third parties about the preferences and characteristics of our users.  Before we share any Usage Data or Personal Data, we use industry standard methods to make sure that the data that we share cannot be identified to you or any other individual user.
  • Third Parties’ Protection of Your Data. We will not share your data with any third party who we know is incapable of keeping your data safe using the same or an equal level of protection as ourselves, or who we know will refuse to keep your data safe using the same or an equal level of protection as ourselves.
  1. Information Others Collect. Other websites, mobile applications and services that you interact with may collect information from you after you leave their website, including information related to your use of the Evidence Collector Platform. We do not control any third party or their collection of your information. Please review the respective party's privacy policy to understand their collection and use of your information.
  1. Data Retention. We will use reasonable efforts not to retain your personal information for any longer than it is necessary for the purposes set out in this Privacy Policy.  Thereafter, we will either delete your data, anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.  If you wish to request that we delete or modify your information, that we or deactivate your account consistent with the foregoing, you may contact us at [email protected].
  1. We do not knowingly solicit data from or market to children under 18 years of age. By using the App, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the App. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.   2. Data Security. We are committed to protecting the data of our users. Even though we take reasonable precautions to protect your data, no security measures can be 100% secure, and we cannot guarantee the security of your data.
